Serbian seedling producer intends to recover over 600 thousand euros from Adyghe partner
Maykop. October 2. INTERFAX - The Arbitration Court of the Republic of Adygea has accepted for proceedings the claim of Grof of Milutovac LLC (Serbia, produces seedlings) against Grove of Maykop LLC (Adygea, produces seedlings) for collection of debt under a contract for the supply of products in the amount of 621,810 euros and a penalty in the amount of 62,181 euros in rubles at the exchange rate of the Central Bank of the Russian Federation on the date of execution of the court decision, according to the court file.
According to court materials, the Serbian company intends to collect the debt for the period from July 15, 2022 to August 16, 2024.
The preliminary hearing is scheduled for November 21.
Grof of Milutovac LLC also filed an application for interim measures with the court. The plaintiff believes that the defendant's actions in terms of long-term failure to fulfill its obligations under the disputed contract, leaving the claim unanswered indicate a deliberate evasion of its obligations, abuse of its rights.
"Analysis of the defendant's financial statements for 2022-2023 showed that a significant part of its assets is accounts receivable - 22,630 thousand rubles (which is more than 50% of assets), the amount of borrowed funds for the period 2022-2023 increased, possibly due to the occurrence of a delay in the repayment of mandatory payments of borrowed funds, which indicates the low liquidity of the defendant's property," the plaintiff said.
Under such circumstances, the Serbian company, according to it, has reasonable concerns about the possibility of subsequent execution of the judicial act, which will be issued based on the results of the consideration of this claim.
The court partially satisfied it and prohibited the Adyghe company from managing an agricultural land plot in the village of Krasnooktyabrsky in the Republic of Adygea, as well as the Office of the Federal Service for State Registration, Cadastre and Cartography for the region from performing registration actions in relation to this land plot.
Grof of Milutovac LLC was founded in Serbia in 1990. According to information on the company's website, its activities are related to the production of grape cuttings, fruit seedlings and rose seedlings. The nursery occupies an area of more than 100 hectares. In one growing season, the company produces 2 million grape cuttings, 2.5 million fruit seedlings and 500 thousand rose seedlings. The LLC supplies seedlings to more than 10 countries, including Russia.
Grof of Maykop LLC was registered in Adygea in 2022. According to the Unified State Register of Legal Entities, Anna Petrova owns 100% of the shares in the company. The main activity is growing seedlings.
